MiarichPay – Secure Payment Solutions

1. Acceptance of Terms
By accessing or using MiarichPay services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
Important: These terms constitute a legally binding agreement between you and MiarichPay. Please read them carefully before using our services.
2. Service Description
MiarichPay provides secure payment processing services, including:
- Online payment processing for merchants
- Mobile payment solutions
- Digital wallet services
- International money transfers
- Merchant account management
- Fraud detection and prevention
Our services are designed to facilitate secure financial transactions while maintaining the highest standards of security and compliance.
3. User Eligibility
To use our services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete information during registration
- Not be prohibited from using financial services under applicable laws
- Not be located in a country subject to economic sanctions
Identity Verification: We reserve the right to verify your identity and may suspend services if verification cannot be completed satisfactorily.
4. Account Registration and Security
Registration Requirements
When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Security Obligations
- Use strong, unique passwords
- Enable two-factor authentication when available
- Notify us immediately of any unauthorized access
- Keep your contact information up to date
- Log out of your account when using shared devices
5. Acceptable Use Policy
You agree not to use our services for:
- Illegal activities or transactions
- Money laundering or terrorist financing
- Fraudulent or deceptive practices
- Sale of prohibited goods or services
- Gambling or adult entertainment (where prohibited)
- High-risk businesses without prior approval
- Circumventing our security measures
Violation of this policy may result in immediate account suspension or termination.
6. Fees and Pricing
Our fee structure is transparent and competitive:
Standard Fees
- Transaction processing fees as disclosed during setup
- Monthly account maintenance fees (if applicable)
- International transfer fees
- Currency conversion fees
Additional Charges
Additional fees may apply for premium services, expedited processing, or specialized merchant requirements. All fees are clearly disclosed before you authorize any transaction.
Fee Changes: We will provide 30 days’ notice before implementing any fee changes to existing services.
7. Transaction Processing
Authorization and Settlement
When you initiate a transaction, you authorize us to process the payment according to your instructions. Settlement times vary based on the payment method and destination.
Transaction Limits
We may impose transaction limits based on your account verification level, transaction history, and risk assessment. These limits are designed to protect both you and our platform.
Failed Transactions
Transactions may fail due to insufficient funds, invalid payment information, or technical issues. We will notify you of failed transactions and provide guidance on resolution.
8. Refunds and Chargebacks
Refund Policy
Refunds are processed according to the policies of the merchant from whom you made the purchase. MiarichPay facilitates refunds but does not determine refund eligibility.
Chargeback Protection
We provide chargeback protection services for merchants, including dispute management and representation. However, the final chargeback decision rests with the card issuer.
9. Compliance and Regulatory Requirements
We operate in compliance with all applicable financial regulations, including:
- Anti-Money Laundering (AML) requirements
- Know Your Customer (KYC) regulations
- Payment Card Industry Data Security Standard (PCI DSS)
- Bank Secrecy Act (BSA)
- Consumer protection laws
You agree to cooperate with our compliance procedures and provide requested documentation.
10. Limitation of Liability
To the maximum extent permitted by law, MiarichPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim shall not exceed the fees paid by you to MiarichPay in the 12 months preceding the claim.
Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures of third-party systems.
11. Account Suspension and Termination
Suspension
We may suspend your account if we suspect fraudulent activity, compliance violations, or other risks to our platform or users.
Termination
Either party may terminate this agreement with 30 days’ written notice. We may terminate immediately for material breaches or legal requirements.
Effects of Termination
Upon termination, we will process any pending transactions and return your remaining balance according to applicable regulations and our standard procedures.
12. Dispute Resolution
Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Greenville, South Carolina.
You waive your right to participate in class action lawsuits against MiarichPay.
13. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email and posted on our website at least 30 days before taking effect. Continued use of our services constitutes acceptance of the modified terms.
14. Governing Law
These terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles.
